What exactly are surplus funds?

Surplus funds (also called excess proceeds or overbid) are the money left over when a property sells at foreclosure or tax sale for MORE than what was owed. For example: If you owed $50,000 and your property sold for $75,000, there's $25,000 in surplus. That money legally belongs to the former property owner — YOU.

Is this legal? Is it really MY money?

Absolutely. In 2023, the Supreme Court unanimously ruled in Tyler v. Hennepin County that surplus funds are the constitutional property of the former owner. Counties cannot keep this money — it belongs to YOU. This is your legal right.

How much money could be waiting for me?
